Alcohol for mothers day

Hi there

My wife runs a home based cake company and she came up with the idea of selling a cupcake a bottle of wine and a glass with a fondant made rose ....

She has sold a few already but we have just thought about selling the wine and realised there may be a problem with it as of course she doesn't have a license .So would this be a problem or will it be OK to keep going as it is just a 1 off and and they are only the small bottles of wine

What a great question!

No experience of this so someone like legalstop might wade in and give a better answer, but with my nosy google search, look at section 1 of the Licensing Act 2003:

Licensing Act 2003

LICENSABLE ACTIVITIES 1

Licensable activities and qualifying club activities (1) For the purposes of this Act the following are licensable activities

(a) the sale by retail of alcohol,

(b) the supply of alcohol by or on behalf of a club to, or to the order of, a member of the club,

(c) the provision of regulated entertainment, and

(d) the provision of late night refreshment.

I think they have got you by the short and curlies. The sale by retail alludes to the selling of unopened alcohol

Yeah hopefully legalstop will come along with a answer ,otherwise will have to change it for non alcohol or something else

Had a friend that had a house party for Charity and got around the licence law by renting out glasses and not actually charging for the alcohol.

Similarly, is there a reason why you couldn't put a hefty charge for the cake with a "free" bottle?

Is it local pick up or posted. That's another issue as most postal services won't carry alcohol as I recently found out posting a gift to my friend (obviously you can send it anyway but then it's not insured). Just thought I'd mention it.


No I am delivery boy ..Well not going to well anyway as only got 4 people wanting so far .. I suppose everyone will be scrambling Friday night wanting them as usual lol ..Thanks Garde that 's a good idea
