Twice last month I got a call at work from someone who didnt identify their namr or what company they were calling form, but claiming I was on an 'ermergency tarriff' (having moved in not so long ago) and they need to put me onto a normal tarrif.

Now this could easily be mistaken by anyone, as it sounds credible enough, except we are in serviced offices and the company name on our lease is NOT the business name this 'scam' company were using when discussing with me (they referred to our trading name, which is completely different and which the Landlord/lease details do not refer to). Therefore I knew the call to be a scam.

They could not tell me our company name, nor my landlords name, yet they were using my trading name and asking for Sara (my business partner) whose name we had only used a) in direct emails with our new customers and b) in some recent directories and forum entries she had done a couple of weeks ago.

We believe this company had scraped the details from a directory listing and were trying to get us to sign up to their utilities company on the pretence they were our current supplier. They rang twice and it was the second time that set more alarm bells ringing as they had no record of the first call where I told them we were in serviced offeices and to take it up with the landlord. It was only after the call I realised they must be onto a scam though I never ever sign anything up on a phone call unless I have called the company and I know 100% who I am dealing with.

As far as I know, they need your signature on the contract so when you receive the court paperwork just argue the case asking for a copy of the signed contract and enter what you have written above.

One of my clients has just had a video done for her new website (yet to be launched so can't show it to you yet).

She used a guy I had met at a networking event who impressed me and we kept in touch, so when the time came I put her in touch with him to buy direct.

I haven't asked what she paid him however, but on getting a quote for someone else last week, he's charging

Before anything, you website needs optimising. It is in Google, but only if you search on 'minster pest control'. Then build links with your keywords.

Yes I see your point Barney, beyond the outline of requirments, you expect a certain level of professional standards to be par for the course which should not need detailing, like using correct spelling, like following a clear simple instruction/requirement (ie please do not use the word 'corgi' at all). But this is all your evidence with this other stuff. I hope that you do win where they are proved to have lied to win your business. Loads out there like that. Someone even said to me yesterday I ought to out some testimonials on a website we have done for a new business I am involved with and I said at the time that because it was brand new business, no customers at that time (even now its too early to get them) there was none to use so she said "make them up" and I said I would never do that. A lot do though.

There arent many folk I would think to recommend but OWG is definitely one so if he can help you are in good hands.

One thing though, you point out about what could/should you have expected them to do, but didnt you know or ask what they would be doing? What exactly did your order/quote consist of? There must have been some written dialogue in a quote and subsequent invoice that outlines what you were getting and any supporting information that you would have sought before entering into a contract surely?

There are no formal qualifications in SEO in the UK so that's not really something you can rely on in court. Most people cant find flaws if they look hard enough even at the best of them.

You would be better off employing the skill of a lawyer who deals with contract law as it is only your contract that will be discussed and what was met or not met.

Don't forget, the court will look at what due dilligence you undertook that made you satisfied enough to place your order and then look at that shortcoming in relation to contract failure and what clauses and disclaimers that were reasonable, in your contract.

How do you see it being unbiased? ie what would make it biased?

Why is it urgernt by the way? Court dates are usually given well in advance.

Are you prepared o pay double time for such short notice? What's your budget for this?

Yeah someone on A1BF suggested that earlier, so will try that next however in the meantime and IT guy he knows gave him another fix which has allowed him to view the website in Firefox (but not IE) going into windows and then hosts ect or something and entering the website address into there. Apparently as a temporary measure. Well it seems to have worked but not a full fix. We will try the DNS suggestion later see if that sorts it out. Meanwhile he says a friend of his also got the 123-reg page yesterday too.
That's the thing, you can have it validate when you hadn it over but if anyone makes any changes to it that could knock something off and suddenly an error can exist, caused by the slightest thing. It is not the be all and end all. We have been making sure all our sites validate on handover, after that, we can't be responsible of coursre, but I take screenshots on the day, and keep them on file plus send to client to view, just so they can see for themselves. It's that little bit of extra mile added into the pot.

We're currently working on increasing its mobile compatibility using the W3C MobileOK Checker Steve recommended.

I think you will find this W3C validation tool says differently. I just asked because I presumed you had run yours through it before posting the thread.
and does your website validate? I know mine does.
